When you have to go to court initially it will usually be to find out whether or not the lender can secure a repossession order from the Courts. It is unlikely that the courts will grant this repossession order on the first hearing. They will in most cases grant a suspended order. In general, the courts take the view that granting an outright repossession order is an extreme measure and should only be done when there is no chance that the borrower can rescue the situation.
Instead they may suspend the repossession order which means that you must abide by the courts ruling which will usually entail repaying the arrears over an agreed period of time. If you do not, the lender can again apply for the repossession order with the courts more likely to take the side of the lender.
If it is clear to the court that you are unable to repay the arrears and are unlikely to do so within a reasonable period of time then it is highly likely that the repossession order will be granted. The court will notify you of the period within which you must leave the property.
If you continue to stay in the property after this date then steps will be taken to evict you and your family.
